Terms of Service

1. Acceptance of Terms

By accessing the Starseed Oracle website (thestarseedoracle.com) or downloading, installing, or using the Starseed Oracle mobile application (collectively, "the Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Services.

These Terms constitute a legally binding agreement between you ("you," "your," or "user") and Awakened Sanctuary LLC, a Hawaii limited liability company ("we," "us," "our," or "Company").

We reserve the right to modify these Terms at any time. Material changes will be notified through the Services or via email. Your continued use of the Services after any modifications constitutes acceptance of the updated Terms. The "Last Updated" date at the top indicates when these Terms were last revised.

2. Description of Services

The Starseed Oracle provides the following services for entertainment and personal reflection purposes:

• AI-powered spiritual guidance and inspirational readings generated by artificial intelligence
• Inspirational and motivational content for personal contemplation
• A virtual currency system ("Crystals") for accessing premium features
• Optional subscription plans for enhanced access to features
• Educational and entertainment content related to spirituality and personal growth

All Oracle readings and content are generated by artificial intelligence for entertainment purposes only. The AI does not have any supernatural, psychic, or predictive abilities. Any spiritual or metaphysical language used in the app is part of the entertainment experience and should not be interpreted literally.

3. Account Creation & Age Requirements

Account Creation: You may access certain basic features without creating an account. Creating an account requires a valid email address and enables access to additional features including your reading history and personalized experience.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

Accurate Information: You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4. Virtual Currency (Crystals) & Purchases

Free Readings: New users receive 3 complimentary Oracle readings upon first use.

Crystal Purchases: Additional readings require Crystals, which can be purchased through in-app purchases:

• 11 Crystals — $0.99 USD
• 111 Crystals — $9.99 USD
• 1,111 Crystals — $99.99 USD

Payment Processing: All purchases are processed through the Apple App Store or Google Play Store. You agree to pay all charges at the prices then in effect for your purchases, and you authorize us to charge your chosen payment provider for any such purchases.

Refund Policy: Due to the digital nature of the Services, all Crystal purchases are final and non-refundable except as required by applicable law. Refund requests must be directed to Apple or Google through their respective refund processes.

Virtual Currency Terms: Crystals are virtual items with no monetary value outside the Services. Crystals: (a) cannot be exchanged for cash, gift cards, or any other form of currency; (b) cannot be transferred, sold, or traded to other users; (c) have no value outside the Services; and (d) may be modified, limited, or discontinued at any time. Unused Crystals are non-refundable.

6. User Content & Conduct

Your Content: You retain ownership of any content you submit through the Services (such as questions to the Oracle). By submitting content, you grant us a non-exclusive, royalty-free, worldwide license to use, store, and process your content solely for the purpose of providing and improving the Services.

Privacy of Questions: Your Oracle questions are processed by AI systems and are encrypted in transit and at rest. We do not manually review your questions except as necessary for technical support or legal compliance.

Intellectual Property: All content, features, functionality, trademarks, service marks, and trade names displayed on the Services are owned by Awakened Sanctuary LLC or its licensors and are protected by intellectual property laws.

7. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Services for any unlawful purpose or in violation of any applicable laws or regulations
• Harassing, threatening, intimidating, or harming other users
• Attempting to gain unauthorized access to our systems, servers, or networks
• Reverse engineering, decompiling, disassembling, or attempting to derive the source code of the Services
• Copying, modifying, distributing, or creating derivative works based on the Services
• Using automated systems, bots, scrapers, or data mining tools to access the Services
• Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with any person or entity
• Interfering with or disrupting the Services or servers or networks connected to the Services
• Circumventing, disabling, or otherwise interfering with security-related features of the Services
• Using the Services to transmit any malware, viruses, or harmful code
• Removing, altering, or obscuring any copyright, trademark, or other proprietary notices
• Using the Services in any manner that could damage, disable, overburden, or impair the Services

We reserve the right to terminate or suspend your access to the Services immediately, without prior notice or liability, for any violation of these prohibited activities.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AWAKENED SANCTUARY LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT OR INFORMATION
• WARRANTIES THAT DEFECTS WILL BE CORRECTED OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS

WE DO NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY CONTENT, PRODUCT, OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE SERVICES OR ANY HYPERLINKED WEBSITE.

YOU EXPRESSLY ACKNOWLEDGE THAT THE ORACLE READINGS ARE AI-GENERATED CONTENT FOR ENTERTAINMENT PURPOSES ONLY AND SHOULD NOT BE RELIED UPON FOR ANY PURPOSE.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such jurisdictions, our liability will be limited to the greatest extent permitted by applicable law.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AWAKENED SANCTUARY LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SERVICES
• DAMAGES RESULTING FROM ANY CONTENT OR INFORMATION OBTAINED THROUGH THE SERVICES
• DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA
• DAMAGES RESULTING FROM ANY DECISIONS OR ACTIONS YOU TAKE BASED ON ORACLE READINGS

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF: (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100 USD).

YOU SPECIFICALLY ACKNOWLEDGE THAT WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM YOUR RELIANCE ON ORACLE READINGS OR ANY DECISIONS OR ACTIONS YOU TAKE BASED ON SUCH READINGS.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, our liability will be limited to the greatest extent permitted by applicable law.

10. Indemnification

You agree to defend, indemnify, and hold harmless Awakened Sanctuary LLC and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from or relating to:

• Your access to or use of the Services
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Your violation of any applicable laws, rules, or regulations
• Any content you submit or transmit through the Services
• Any claims that your use of the Services caused damage to a third party

11. Changes to Services

We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

We may also impose limits on certain features or restrict your access to parts or all of the Services without notice or liability.

12. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Hawaii, United States of America, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Honolulu County, Hawaii, and you consent to the personal jurisdiction of such courts.

13. Dispute Resolution & Arbitration

Informal Resolution: Before filing any formal legal claim, you agree to first contact us at support@thestarseedoracle.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute through good faith negotiations within 60 days.

Binding Arbitration: If informal resolution fails, any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall take place in Honolulu, Hawaii, or at another mutually agreed location, or may be conducted remotely via video conference.

Class Action Waiver: YOU AND AWAKENED SANCTUARY LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the jurisdiction of such court.

Opt-Out Right: You may opt out of this arbitration agreement by sending written notice to support@thestarseedoracle.com within 30 days of first accepting these Terms. Your notice must include your name, address, email address, and a clear statement that you wish to opt out of arbitration.

14. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination: (a) your right to use the Services will immediately cease; (b) any unused Crystals will be forfeited; and (c) provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

You may terminate your account at any time by contacting us at support@thestarseedoracle.com or by deleting your account through the app settings.

15. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Awakened Sanctuary LLC regarding the Services and supersede all prior agreements and understandings.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not be considered a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

Force Majeure: We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
